This is a sample contract which details both breeder and customer obligations.
LABRADOODLE PURCHASE AND SALES AGREEMENT
AGREEMENT
Made between Great Day Labradoodles, LLC PO Box 429 Dundee, Oregon 97115 (“Sellers”) and the Purchaser set forth above(“Buyer”).
Seller hereby sells to Buyer the following pet Labradoodle (collectively referred to as the “Dog”) described below.
FULL PAYMENT IS DUE ON OR BEFORE DOG IS 7 WEEKS OLD
(There is a 3.5% charge on the total purchase price, when you use pay pal/credit cards for payment.)
Warranties and registration are void until puppy is spayed or neutered and certificate is sent to Lisa Jenkins.
Lisa Jenkins warrants a healthy puppy upon arrival and initial vet check within 4 days (see warranties below).
1. REPRESENTATIONS
a. Seller warranted clear title to dog.
b. Dog will be in good health on the date of delivery and is warranted as set forth in Paragraphs 3 and 4 below.
c. Seller will provide registration papers (pedigree) of the Dog, certified by Seller to be correct, to the best of its knowledge.
d. All of the Dog’s health records, genetic testing (if any) will be provided to Buyer and are accurate to the best of Sellers knowledge.
2. BUYER WARRANTS
a. Buyer acknowledges that the Dog is being sold as a pet. b. Buyer is not acting as agent in the purchase of the Dog and is buying the Dog for its own pet. Buyer will not at any time, sell the Dog to any agent, animal broker or pet store. c. Buyer will use the kennel name of “Great Day” in all registration papers for the Dog.
3. HEALTH WARRANTY
The Dog will be delivered in good health and free, to the best of Seller’s knowledge, from genetic defect and communicable diseases. Seller has taken every reasonable precaution to ensure the physical soundness and temperament of the Dog. To the best of Seller’s knowledge, the Dog’s sire and dam are free of hereditary defects.
Upon receipt of the Dog,
Buyer has 4 days (recommended in the first 48 hours) to take the Dog to a veterinarian of its own choice to determine the Dog’s physical condition. If satisfied with the veterinarian report, Buyer will retain possession of the Dog and hold Seller harmless and not liable for any further medical conditions of the Dog. If any Dog is found to be in a general state of poor health or is found to be seriously ill by the Veterinarian’s report,
Buyer shall immediately provide Seller with a copy of said report and may return the Dog to the Seller within two days of the veterinarian examination at Seller’s expense. Seller will replace or refund the amount paid for the Dog, at its option.
SELLER ASSUMES NO RESPONSIBILITY FOR ANY HEALTH RELATED ISSUES OR LOSS OF LIFE DUE TO REACTIONS CAUSED BY VACCINATIONS OR FLEA AND TICK PREPARATIONS ADMINISTERED EITHER ORALLY OR ON THE SKIN SURFACE. Seller has not given leptospirosis to the dog.
4. SPECIAL PROVISIONS
For any Dog that is under the age of three on the date of signing this agreement, the following genetic guarantees will apply.
If the Dog dies from a genetic illness or defect within three years of its whelp date (but not because of a condition caused by or contracted while in the Buyer’s possession), the Dog will be replaced as soon as a replacement dog is available, or Seller will, at its option, refund 1/2 the purchase price. All of the above claims will be honored with a certified written report from a licensed veterinarian of Buyers choice (at its own expense).
The Dog sold is being sold as a suitable pet and Seller guarantees the Dog as such.
Seller agrees that if at the age of three or under Dog is diagnosed with a genetic disorder that is a serious, life threatening condition Seller will reimburse Buyer the veterinary costs for treatment of the condition for up to 1/2 the purchase price of the Dog, if Dog is kept by Buyer, OR provide an additional dog to Buyer from an agreed upon litter. Two independent veterinary examinations and reviews must be provided to Seller confirming the genetic disorder. In the case of hip or elbow displaysa the diagnosis must come from a certified Pennhip or OFA report. Seller reserves the right to get a second PennHip or OFA test or opinion, at its expense, before replacing the Dog. Reimbursement of veterinary fees is provided to Buyer upon receipt of copies of the medical reports. Reports must state the treatments provided and fees for the treatments. Seller will only reimburse for fees directly related to treating the genetic disorder or condition and will not reimburse the costs associated with diagnostics or testing. Seller will not be held responsible for the development of faults, diseases or disorders which are the direct result of environmental factors, vaccinations, or Buyers' negligence. Buyer understands that if they choose to keep the dog and medical treatment expenses exceed 1/2 the purchase price paid for the Dog, Seller is not liable for those fees. Buyer will pay all transportation costs.
The genetic guarantees contained herein will be null and void if Dog if the is found to be overweight or in a poor state of nutrition or health.
In the event of replacement, the Buyer does not want to keep the Dog and the Dog cannot be placed in a suitable home, Dog will be returned to Seller, at Buyer’s Expense.
The HEALTH WARRANTY and SPECIAL PROVISIONS apply only to the buyer and are not transferable to a subsequent owner.
5. DISPOSITION OF DOG
Buyer agrees that if it desires to destroy or give away the Dog, Buyer will notify the Seller and give the Seller the opportunity to help re-house the Dog. The Dog must not be given away to a pound or shelter.
6. BUYER OBLIGATIONS
Buyer agrees to take the proper safeguards for the care, safety and well-being of the dog, including but not limited to a fenced yard or proper kennel, adequate shelter, feeding (not allowing to be overweight or obese), exercise, socialization, proper diet and of special importance, obedience training. Disregard for any of the above voids any warranties under this Agreement.
7. JURISDICTION
This Agreement will be construed in accordance with the laws of Oregon. If any legal action is to be taken by either Buyer or Seller venue shall be in Yamhill County, Oregon.
8. SEVERABILITY
If any provision of this document shall be deemed unenforceable or against public policy or any statute, all other provisions of this Agreement shall remain in full force and effect.
9. BINDING AGREEMENT
This Agreement will be binding upon receipt of the deposit (non-refundable) and by Seller faxing or mailing a signed copy to the Buyer.
All of the terms of the parties’ Agreements are incorporated into this document and no parole evidence or statements made by Seller’s family and friends shall be deemed part of this Agreement. The parties expressly agree that this document constitute the entire agreement between the parties and supersedes all previous negotiations and agreements in relation to this transaction.
The undersigning hereby acknowledge reading and understanding the entire Agreement and agree to be bound by the terms hereof.

In addition to my 3 year genetic health warranty, your puppy comes homes with 1 month of Trupanion pet insurance. This coverage must be activated the day of pickup by you. Trupanion will call you to verify information that I have given them. Because I sign all puppies up before they leave my home, they go home with you covered and with no preexisting conditions. Maintaining the insurance is optional to you.
